These Terms of Use ("Terms") govern your access to and use of FinNexus Terminal, including the website, the research terminal, the funds module and any related features (together, the "Service"). By creating an account, or by using the Service, you agree to these Terms, to the Privacy Notice and to the Risk & No-Advice Disclosure, which form part of them. If you do not agree, do not use the Service.
1. What the Service is — and is not
The Service is a research and analytical software tool. It retrieves, stores and computes publicly available market and company information and presents it, together with formulas, rule-based checks, scores, screens, backtests, portfolio arithmetic and, where enabled, machine-generated text, for your own information and education.
The Service does not provide investment, financial, legal, tax or accounting advice, and nothing in it is a recommendation. In particular:
- No content is a personal recommendation, a solicitation, or an offer to buy, sell or hold any security, fund or other financial instrument, or to adopt any investment strategy.
- Scores, ratings, bands, screens, rankings, sentiment readings, red-flag checks, backtests and debates are mechanical outputs of stated rules applied to stored data. They describe data; they do not assess whether any instrument is suitable or appropriate for you.
- The Service does not take your financial situation, objectives, knowledge, experience or risk tolerance into account.
- FinNexus Terminal is not registered or authorised as an investment adviser, research analyst, broker, dealer or portfolio manager with any regulator, including the Securities and Exchange Board of India (SEBI), the UK Financial Conduct Authority (FCA), the US Securities and Exchange Commission (SEC), the Canadian Investment Regulatory Organization (CIRO) or any Canadian provincial securities regulator, the European Securities and Markets Authority (ESMA) or any national authority of an EU member state (including France's AMF, Germany's BaFin and Italy's CONSOB), Japan's Financial Services Agency (FSA), the China Securities Regulatory Commission (CSRC) or Hong Kong's Securities and Futures Commission (SFC). The Service is not a research report within the meaning of the SEBI (Research Analysts) Regulations, 2014, nor investment advice within the meaning of the SEBI (Investment Advisers) Regulations, 2013, the UK Financial Services and Markets Act 2000, or the US Investment Advisers Act of 1940, nor investment advice or research under the equivalent laws of Canada, the European Union, Japan, the People's Republic of China or Hong Kong.
- The Service does not hold client money, execute or route orders, or connect to any brokerage account.
You are solely responsible for your investment decisions. Before acting on any information, verify it independently and consider obtaining advice from a suitably qualified and regulated professional.
2. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide a valid email address, keep your password confidential, and tell us promptly of any unauthorised use of your account. You are responsible for activity under your account.
- One person per account. Accounts may not be shared, sold or transferred.
- Administrator roles are granted only by the operator. Administrators may refresh shared market data; other users analyse that data and manage their own records.
3. Data, sources and accuracy
- Market data, company fundamentals, fund information and headlines are obtained from third-party and public sources, including exchange and regulatory publications, data aggregators and news feeds. Each figure is shown with its source and date where available. Third-party names and marks belong to their owners; their appearance does not imply endorsement.
- Data may be delayed, incomplete, revised, mis-reported by its source or incorrectly processed. Prices are stored closes, not live quotes. The Service is provided for information only and must not be relied on as the sole basis for any decision.
- Where the Service cannot obtain or compute a figure it says so ("n/a") rather than estimating it; the absence of a warning is not an assurance.
- Backtests and track records are hypothetical, are computed with hindsight on historical data, and do not account for every cost, tax, liquidity constraint or market impact. Past performance, simulated or actual, is not a reliable indicator of future results.
- Machine-generated text (for example SWOT summaries, Bull vs Bear debates and their summaries) is produced by third-party AI models from the stored evidence. It may be incomplete or wrong, is audited against that evidence only on a best-efforts basis, and is not the opinion of FinNexus Terminal.
- News sentiment is a rule-based reading of headline wording over a recent window. It reflects coverage, not the merits of a company, and is never part of the score.
4. Your content
You keep all rights in the information you enter or upload — for example watchlists, portfolio positions, fund transactions and account statements ("Your Content"). You grant FinNexus Terminal a limited licence to store and process Your Content only to provide the Service to you. You confirm you have the right to upload it and that it does not include another person's personal data without their permission. Your Content is private to your account; it is not shown to other users and is not used to build anything shown to them.
5. Acceptable use
You must not:
- scrape, bulk-download, resell, redistribute, sub-license or commercially exploit the Service or data obtained through it, or use it to build a competing data product;
- access the Service by automated means other than its published interfaces, or in a way that overloads it or its data sources;
- attempt to bypass authentication, rate limits, access controls or security measures, or probe for vulnerabilities without written permission;
- reverse-engineer the Service except to the extent the law allows despite this restriction;
- use the Service to give investment advice or recommendations to others, or present its outputs as your own regulated advice or research;
- use the Service unlawfully, including for market manipulation, insider dealing or any breach of securities law.
6. Intellectual property
The Service, its software, design, methods and text (other than Your Content and third-party data) belong to FinNexus Terminal or its licensors. You receive a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own research in accordance with these Terms.
7. Availability and changes
The Service is provided on an "as is" and "as available" basis. It may be interrupted, changed, limited or withdrawn at any time, including features that depend on third-party sources. We may change these Terms; the version and date are shown above. If a change is material, you will be asked to accept the new version before continuing to use your account.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law: (a) all warranties, conditions and representations — express or implied, including as to accuracy, completeness, timeliness, merchantability, fitness for a particular purpose and non-infringement — are excluded; and (b) FinNexus Terminal is not liable for any trading or investment losses, loss of profit, opportunity, data or goodwill, or any indirect or consequential loss, arising from your use of or reliance on the Service or any data or content in it, however caused. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim (which, for a free service, is zero) or the minimum the law allows. Nothing in these Terms limits liability that cannot lawfully be limited, such as for death or personal injury caused by negligence, or for fraud, or your statutory rights as a consumer.
9. Indemnity
You agree to indemnify FinNexus Terminal against claims, losses and costs arising from your breach of these Terms, your misuse of the Service, or your infringement of any third party's rights.
10. Suspension and termination
You may delete your account at any time from Account & security; your private data is then deleted as described in the Privacy Notice. We may suspend or close accounts that breach these Terms or put the Service or its users at risk. Sections 1, 3, 6, 8, 9 and 11 survive termination.
11. Governing law
These Terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction, except that you may also benefit from any mandatory consumer-protection rules and courts of the country where you live.
